Terms of Service

Welcome to Kinlet. By accessing or using our application and website at kinletstudio.com("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Account Registration

You must create an account to use Kinlet. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years old to use the Service. You agree to provide accurate and complete information during registration and to keep it up to date.

2. Your Content

You retain full ownership of all content you create on Kinlet— journal entries, photos, audio recordings, and books are yours. By using the Service, you grant us a limited license to store, process, and display your content solely to operate and improve the Service (for example, generating AI-powered suggestions or rendering your book for print).

You are responsible for ensuring you have the rights to any content you upload, and that your content does not violate any applicable laws or third-party rights.

3. AI-Powered Features

Kinlet uses artificial intelligence (Google Gemini) to provide features such as daily question generation, photo captioning, and content suggestions. AI-generated content is provided as-is and may not always be accurate. You are responsible for reviewing and approving any AI-generated content before it is included in your journals or books.

4. Subscriptions & Payments

Kinlet offers free and paid subscription plans. By subscribing, you authorize us to charge your payment method on a recurring basis through Stripe. You can cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period.

AI Features

Your subscription includes access to all AI-powered features (e.g., prompt generation, photo analysis, voice transcription). Usage is subject to reasonable limits to prevent abuse. We reserve the right to throttle or suspend access for accounts exhibiting abnormal usage patterns.

Refunds

Subscription fees are generally non-refundable. If you believe you were charged in error, please contact us within 30 days at support@kinletstudio.com.

5. SMS Journaling Program (Kinlet SMS Journaling)

Kinlet offers an optional SMS journaling program ("Kinlet SMS Journaling") that delivers daily journal questions to your phone via text message. By verifying your phone number, checking the consent checkbox, and enabling an SMS schedule, you expressly consent to receive recurring automated text messages from Kinlet. This feature is part of the Kinlet journaling service and is not a marketing program. To opt in, visit our SMS Program Terms & Opt-In page.

Program Details

• Program name: Kinlet SMS Journaling
• Message frequency: Up to 2 messages per day. You control the frequency in your account settings.
• Message and data rates: Standard message and data rates may apply depending on your mobile carrier and plan.
• Carriers: Carriers are not liable for delayed or undelivered messages.

Opt-Out

You can opt out of SMS messages at any time by replying STOP to any message from Kinlet. You will receive a confirmation message and no further SMS messages will be sent. You may also reply START to re-subscribe. You can also disable SMS schedules or remove your phone number from your account settings.

Consent

Consent to receive text messages is not a condition of purchase or use of any other Kinlet feature. You may use Kinlet without opting in to SMS. Your SMS opt-in data and consent will not be shared with any third parties for marketing or promotional purposes.

6. Print-on-Demand Orders

When you order a printed book, it is produced on demand. Once an order is submitted for printing, it cannot be cancelled. Delivery times and shipping costs depend on your location and selected shipping method. We are not responsible for delays caused by shipping carriers.

7. Sharing & Collaboration

You may invite collaborators to specific journals. You control access and can revoke it at any time. You are responsible for the content contributed by collaborators you invite.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that is defamatory, obscene, or infringes on third-party rights
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape, harvest, or extract data from the Service
• Resell, redistribute, or sublicense the Service

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your content may be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Kinlet and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated content is provided without warranty of accuracy or fitness for any particular purpose.

12. Intellectual Property

The Kinlet name, logo, and application design are our intellectual property. You may not use our branding without written permission. All open-source libraries used in the Service are subject to their respective licenses.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the province of Quebec, Canada, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Quebec.
